PHOENIX SPA RESORT VIP GOLD Gift Certificates in Euros, Canadian Dollars, British Pounds and US Dollars are issued by and are the property of Snapdragon Eirl Corporation doing business as (Phoenix Spa Resort Condominium) with registered office at 5 calle principal . Cabarete, Sosua Puerto Plata 57000. Dominican Republic.
PHOENIX SPA RESORT VIP GOLD Gift Certificates are sold subject to these Conditions. By purchasing a PHOENIX SPA RESORT VIP GOLD certificate, and BY ACCEPTING THE GENERAL CONDITIONS OF THE GIFT CERTIFICATE, you will be deemed to have read and accepted these Terms and Conditions. GIFT CERTIFICATES ARE NON-REFUNDABLE AND NOT MONEYABLE.
Preamble:
WHEREAS Phoenix Spa & Resort Condominium is a resort located at 5 Calle Principal, Cabarete, Sosua, Puerto Plata 57000, Dominican Republic;
WHEREAS the Gift Certificate that is the subject of this contract will be delivered by Snapdragon Eirl Corporation(Phoenix Spa & Resort Condominium)or any mean of a courier.
WHEREAS the Buyer wants to benefit from Gift Certificates Sold by the WEB at Phoenixcabarete.com (Snapdragon Eirl Corporation);
THEREFORE;
1.The preamble is an integral part hereof;
2.In consideration of the amount paid, the buyer enjoys multiple weeks of accommodation in the Phoenix Spa Resort Condominium, under the terms and conditions described in Article 8 of the term and condition. And everything depends on the number of gift certificates that the buyer wants to acquire. Booking fees are mandatory as well as the all-inclusive VIP program. (Food and Alcohol).
3.Duration of GOLD Phoenix Spa Resort VIP Gift Certificate and for an indefinite duration.
4.Phoenix Spa & Resort Condominium will take the necessary steps to ensure that the residence is managed professionally. It may transfer the management of the residence to individuals or a company with some experience in this field, but such delegation can not exclude Phoenix Spa & Resort Condominium from its management responsibilities;
5.Phoenix Spa & Resort Condominium undertakes to maintain in force liability insurance cover, for an amount equivalent to that of accommodation services, in order to cover the damage that may be suffered by the MEMBER during his stay at Phoenix Spa & Resort Condominium;
6.Phoenix Spa & Resort Condominium can not be held responsible for the unavailability of a unit that has been booked if the reason for this non-availability is due to a cause beyond the control of Phoenix Spa & Resort Condominium and that can be likened to a force majeure. This could not be a reason to request the cancellation of gift certificates or receive any compensation;
7. The booking fee is mandatory upon request of a reservation. The Holder of a VIP GOLD Phoenix Spa Resort Gift Certificate, Must Acquire All Booking fees and all-inclusive package (Food, and alcoholic drink) from the request for the reservation;
8. The holder of the gift certificate is entitled to a stay of 8 days and 7 nights in a One-bedroom Executive condo. The condo consists of a closed bedroom, a living room with sofa sectional, a kitchen completes with pots and pans. Depending on availability, you can choose between 1 king-size bed, 1 queen-size bed or 2 double beds. Reservation of 199.00 plus taxes are applicable. (10% tourist tax plus 18% Dominican taxes). You will have access to: Private cabana with Jacuzzi, access to the private beach, unlimited Wi-Fi, unlimited long distance calls in North America, gourmet coffee in the morning, 20% discount on all-inclusive packages, 50% discount on a wine list, access to the Phoenix theater, access to the Porto Fino VIP section, access to the Lazy River & Rock baths, access to the gym, laundry for 10 (ten) clothes .2 hours of massage, 2 hours of riding, 2 hours of mountain biking or 2 hours of scooter. Phoenix Spa & Resort only. All suggested prices are subject to applicable taxes from the country. Phoenix Spa & Resort reserves the right to change prices, terms and conditions without notice.

As a welcome gift, Phoenix Spa & Resort Condominium offers you your first year of RCI (Resort Condominium International) free of charge. The subscription to RCI service (resort condominium international) is totally independent of the purchase agreement (Invoice) concluded with Phoenix Spa & Resort Condominium . (Snapdragon Eirl)
10. By joining RCI (international condominium resort), you can enjoy many benefits offered by this company including to book accommodation in nearly 102 countries around the world! Attached is a summary of the RCI (International Condominium Resort) program for your information.
11.As Phoenix Spa & Resort Condominium and RCI (International Condominium Resort) are entirely separate and independent of each other, the affiliation or membership of Phoenix Spa & Resort Condominium or the Member (acquirer) with RCI does not affect the purchase agreement of the gift certificate between the member (acquirer) and Phoenix Spa & Resort Condominium.
12.As long as you keep your subscription with RCI (Resort Condominium International) in effect, you will receive RCI Vacation Points per year, depending on the terms and conditions that bind you with that company.

DISPUTE

21.The GOLD VIP Gift Certificate can only be used for full or partial payment of room reservations (Condo) at the Phoenix Spa & Resort Condominium in the Dominican Republic, in the City of Cabarete.
• GOLD VIP Gift Certificates are redeemable subject to availability, at the discretion of Phoenix Spa & Resort Condominium hotels.
• All room bookings exchanged for GOLD VIP Gift Certificates must be pre-booked online at WWW.phoenixcabarete.com or via our Telephone or Email reservation team [email protected]. The GOLD VIP Gift Certificate (s) must be presented at check-in at the hotel before the services are used.
• GOLD VIP Gift Certificates may not be redeemed in whole or in part for cash [no changes will be made].
• We can not be held responsible for the loss or theft of the GOLD VIP Gift Certificate. GOLD VIP Gift Certificates are not replaceable if lost, damaged, stolen. They are canceled if they are altered, photocopied or reproduced.
• Your use of the GOLD VIP Gift Certificate is subject to government approval, regulations, restrictions and applicable taxes of the destination.
• If your use of GOLD VIP Gift Certificate raises a tax liability, including disclosure, that liability is your sole responsibility.

3.La durer des Certificats Cadeaux VIP GOLD Phoenix Spa Resort et pour une durée indéterminé.
4.Phoenix Spa & Resort Condominium prendra les moyens nécessaires afin que la résidence soit gérée de façon professionnelle. Elle pourra transférer la gestion de la résidence à des personnes ou à une entreprise ayant une certaine expérience dans ce domaine, mais une telle délégation ne saurait exclure Phoenix Spa & Resort Condominium de ses responsabilités de gestion;
5.Phoenix Spa & Resort Condominium s’engage à maintenir en vigueur une couverture d’assurance responsabilité, pour un montant équivalent à celui des services d’hébergement, afin de couvrir les dommages que pourrait subir le MEMBRE lors de son passage à Phoenix Spa & Resort Condominium;
6.Phoenix Spa & Resort Condominium ne pourra être tenue responsable en cas de non-disponibilité d’une unité qui aurait été réservée si la raison de cette non-disponibilité est due à une cause hors du contrôle de Phoenix Spa & Resort Condominium et qu’elle peut être assimilable à une force majeure. Il ne pourrait s’agir d’une raison pour demander l’annulation des certificats cadeaux ou recevoir une compensation quelconque;

Le ou les Certificats Cadeaux VIP GOLD doivent être présentés lors de l’enregistrement à l’hôtel avant que les services ne soient utilisés.
